Gift Cards Policies

Effective Date: July 1, 2026

These Gift Card Terms & Conditions (“Terms”) govern the purchase and use of physical and electronic gift cards (“Gift Cards”) issued by One of Us, located at 3085 University Ave, San Diego, CA 92104 (“One of Us,” “we,” “us”). By purchasing or redeeming a Gift Card, you agree to these Terms.

1. Purchasing a Gift Card

  • Gift Cards may be purchased online at https://order.toasttab.com/egiftcards/one-of-us or in person at One of Us.

  • Gift Cards are sold in denominations selected at checkout and may be purchased as physical cards or electronic (digital) gift cards delivered by email.

  • Payment is due in full at the time of purchase. Gift Cards are treated as a cash equivalent once issued.

  • One of Us is not responsible for delays in email delivery of electronic Gift Cards due to incorrect recipient information provided at purchase.

2. No Expiration Dates or Fees

In accordance with California law, One of Us Gift Cards do not expire and are not subject to service fees, dormancy fees, inactivity fees, or maintenance fees of any kind. The full value of a Gift Card remains available to the holder until fully redeemed.

3. Cash Redemption of Low Balances

California Civil Code § 1749.5 requires that a Gift Card with a remaining balance of less than $15.00 (effective April 1, 2026; $10.00 prior to that date) be redeemable for its cash value upon the holder’s request. Guests may request this cash-out at the point of sale from any bartender, server, or manager.

4. Redemption

  • Gift Cards may be redeemed for food, beverage, merchandise, and event or rental bookings at One of Us, subject to applicable law (Gift Cards cannot be redeemed for alcohol purchases by anyone under 21).

  • Gift Cards may be applied toward a purchase in combination with other forms of payment. If a purchase exceeds the Gift Card balance, the remaining amount is due via another payment method.

  • Applicable California sales tax is calculated and applied at the time of redemption, not at the time of Gift Card purchase.

  • Gift Cards cannot be redeemed for cash except as required under Section 3 above, or as otherwise required by law.

5. Lost, Stolen, or Damaged Cards

Treat your Gift Card like cash. One of Us is not responsible for lost, stolen, or damaged physical Gift Cards or for electronic Gift Cards sent to an incorrect or inaccessible email address. If a physical Gift Card is registered to a guest profile with us and has a remaining balance, we will make reasonable efforts to assist with a replacement, but replacement is offered at our discretion and is not guaranteed.

6. Non-Transferability of Liability and Resale

Gift Cards may be given as gifts and used by any holder in possession of the card or code. One of Us Gift Cards may not be resold, auctioned, or redeemed for cash by any third-party reseller, and we reserve the right to deny redemption of any Gift Card we reasonably believe was fraudulently obtained, altered, duplicated, or resold in violation of these Terms.

7. Promotional and Bonus Cards

From time to time, One of Us may issue promotional gift cards, bonus cards, or credits at no cost or as part of a marketing offer (for example, a bonus card issued with a qualifying purchase). Promotional cards may carry a stated expiration date and are not subject to the cash redemption requirement described in Section 3, consistent with the statutory exception for promotional gift certificates. Any such terms will be disclosed on the card or at the time of issuance.

8. Unclaimed Balances

Because One of Us Gift Cards carry no expiration date and no dormancy or service fees, they are exempt from California’s unclaimed property (escheat) reporting requirements. Your Gift Card balance remains valid and available to you indefinitely, regardless of how much time has passed since your last purchase.

9. Changes to These Terms

One of Us may update these Terms from time to time to reflect changes in law or our business practices. Updates will be posted on this page with a revised “Last Updated” date. Changes will not reduce the value or remove the no-expiration protection of a previously purchased Gift Card.

10. Questions
